So, you or a loved one been hurt in automobile accident or a trucking accident and you’re missing some work; and in fact, you may miss more work. Can you recover those lost wages in any claim that you might have?

Hi, I’m Brad Parker, the attorney you want but hope you never need and this is another edition of Bar Talk.  Give me 90 seconds I’ll give you an answer.

Many times, if you’re seriously injured in an automobile or trucking accident, it results in you missing a lot of work.  The question becomes whether or not you can return to work, when you can return to work and whether or not you’ll be able to do the same thing you did before the accident. All of those are very important questions and form the basis of your lost wage claim.

Obviously if you miss work, you can get lost wages or the lost wages that you’ve incurred

or might incur. If you’re going to miss work in the future, the question becomes how much work you are going to miss and can you return to the same function or level and capacity. If you can’t then you might have what we call a loss of wage-earning capacity and oftentimes that requires function tests to determine what it is you can and cannot physically do that would allow you to re-enter the workforce at a different maybe different pay different job something like that.

But the bottom line is this you can absolutely recover your lost wages and your lost earning capacity. It takes a little bit of time and expert testimony sometimes if you’re going to miss work in the future or you can’t return to the same job that’s why it’s so important to get competent legal advice from a board-certified specialist.
