An action for Wrongful Death can be brought by a descendant's spouse, parents or children. Wrongful Death damages belong to the person bringing the action. An action for the pain and suffering experienced by the deceased before their death can be brought by the deceased's estate.
In spite of significant safety improvements in automobiles and in road design, car accidents continue to be common occurrences. Texas Vehicle Accidents

At Parker Law Firm, we hope that you are never involved in a serious accident, but if it does happen, you should be prepared. In the case that you are ever involved in a motor vehicle accident, there are some key steps that you should follow to make sure that you are protecting yourself, both immediately after the accident as well as into the future. Here is what you should do in the case of a motor vehicle accident:
- Do not leave the scene of the accident
- This is a very important point for any accident. Assuming that it is safe (you are in a well-lit, populated area), you should always stay at the scene until authorities or a tow truck arrives.
- Ensure that the other driver and passengers are safe
- You should always make sure that anyone who is involved in the accident is conscious and not seriously injured. If someone may be seriously injured, you should not attempt to move them before medical personnel arrive on the scene. The only exception is if there is potential danger if they are not moved (for example, there is a gas hazard)
- Call the Police and Your Insurance Company
- Even if there are not serious injuries or damages, it may be a good idea to report the accident to the proper authorities and have them file a report. Your insurance company will need to have as many details as possible and it is valuable to contact them quickly so that all of the information is fresh.
- Be sure to exchange information with other drivers and talk to any witnesses
- You should get contact information (names, addresses, phone numbers, drivers license and plate numbers) as well as insurance information. It is also a good idea to exchange information with any passengers.
- Take pictures of the damage
- You can use the camera on your cell phone if necessary to take pictures of the car damage. This is valuable to have before the vehicles are moved from the scene. Your insurance company or your lawyer can use these images to help you prove your case.
- Never admit fault
- It is not a good idea to admit fault for an accident. There may be items that come to light after the accident and you do not want to put yourself in a bad position by admitting fault prematurely.
- Track medical expenses
- While you may initially feel fine after the accident, you may also have injuries that do not appear until days or weeks later. Tracking any medical expenses you incur will make it easier to collect damages later down the line.
